What Is Chapter 13?

Chapter 13 bankruptcy is referred to as Adjustment of Debts of an Individual With Regular Income. It is specifically designed for an individual or family with a regular source of income and can, therefore, be required to repay some of the debt owed. Surprisingly, Chapter 13 may be a better option than Chapter 7 for many people because it allows you and your lawyer to propose a repayment plan that works for you, while keeping your house, car and all other property you wish to hold onto. Under Chapter 13, the bankruptcy court trustee oversees the plan, typically from three to five years. As long as you make payments according to the plan, creditors will not seize your property. A real benefit is that ALL debt can be included in the plan, including government-backed loans such as student loans and SBA loans.
